Introduction

The use of the ENVISION e-learning platform, including web crawling, its caching services and any other services provided by the platform, requires the unconditional acceptance of the terms of use described herein and constitutes their practical acceptance. By accessing or using the platform, you agree to be bound by these terms, as well as the terms of the Privacy and Security Policy. Users are kindly requested to check these terms at regular intervals for any changes, as the continued use of the platform implies that they accept any possible modifications thereto.

Use of the ENVISION E-Learning platform

These terms of use apply to the ENVISION e-learning platform users. Please read them carefully, because by using this website, you agree to be legally bound by and comply with its terms. If you do not agree with these terms of use, you are not authorized to use the ENVISION e-learning platform.

These terms of use apply to the ENVISION e-learning platform only, and not to the websites of any other institutions, companies or universities members of the ENVISION Consortium.

The ENVISION Project’s Consortium (hereinafter referred to as the ‘Partners’) provides access to and use of this e-learning platform on the following terms:

• You agree to use this website only for legal purposes and in a manner that does not infringe on, limit, or prohibit anyone else’s use and enjoyment of it. Harassing or causing distress or discomfort to others, transmitting obscene or offensive content, or disrupting the regular flow of communication on this website are all prohibited behaviors.
• You may not probe, scan or test the vulnerability, nor breach the security or authentication measures on the website or any network connected to it.
• It is strictly prohibited to interfere with the proper functioning of the website, or any other person’s use of the website by using any automatic or manual device, program, algorithm, or methodology.

The ENVISION Consortium holds all copyright, trademarks, design rights, patents, and other intellectual property rights (registered and unregistered), as well as all content on this e-learning platform. Users must respect all copyright notices and restrictions contained on the ENVISION e-learning platform. 

Unless otherwise specifically stated, it is strictly prohibited to copy, reproduce, republish, disassemble, decompile, download, post, broadcast, transmit, or make available to the public any ENVISION training material (portion, file, content or information). 

You may only download one machine-readable copy of the purposely provided website materials under the following terms:

Accuracy of Content and Information

The ENVISION training material content has been carefully checked at best of knowledge. However, all warranties, terms and conditions of satisfactory quality and fitness for purpose are excluded to the fullest permitted by Law.

In particular, ENVISION partners shall not be liable for any direct, indirect, consequential, or other damages suffered by a trainee or any third party resulting from the use of the content of the ENVISION e-learning platform and/or training programs.

The ENVISION training material may be updated as required by ENVISION partners at any time within the ENVISION training program to reflect knowledge update, educational improvement or correct any errors that may have been detected.

These terms of use apply only to the ENVISION e-learning platform, and not to other websites. When we link to other websites we will try to make it as clear as possible that you are leaving this website. In case the users of the ENVISION platform are redirected to third party websites through special links (links, hyperlinks, banners, etc.) we are not responsible for the terms of management and protection of personal data that these websites follow and we recommend that you read the privacy policy of each site you are visiting.

Liability

Service compliance and security

Although we make every effort to design, program, and provide the best website possible, we cannot guarantee that this website, or any content, service, or feature of this website, will be error-free, uninterrupted, or compliant with all hard- and software, or that your use of the website will lead to the desired results. This website and its contents are provided “as-is” and “as-available”.

Minimal IT skills and equipment are required for the ENVISION e-learning platform:

• Broadband Internet access
• A modern web browser that complies with nowadays web standards and activates features such as session cookies (platform authentication), JavaScript (platform tool features, interactivity, visual effects, etc.), Adobe Reader® plugin (pdf document view), etc.
• An office software suite properly installed and configured on your computer to process standard text, spreadsheet or presentation files.

IMPORTANT: Non-complying with any of the above criteria could lead to user experience problem that would not be under ENVISION responsibility.  

Finally, although we work very hard to develop the most secured website possible, we cannot guarantee that any files or data you download from the site will be free of viruses or destructive features. We exclude, to the fullest extent permissible by Law, all liability for any loss or damages (direct, indirect, or consequential) relating to these terms, or to your (or any third party’s) use or inability to use the e-learning platform, or to your placement of content on the e-learning platform, or to your reliance upon information obtained from or through the e-learning platform.

You agree to defend, indemnify and hold us, our directors, employees and agents harmless from and against any and all claims, liabilities, damages, losses or expenses, including reasonable legal costs, arising out of or in any way connected with any breach of these terms of use by you.

This Privacy Statement explains how we collect, transfer, process, use and disclose your data and sets out our security practices as well as information about what the platform users should do if they don’t wish the collection or further processing of their personal information during their visit to the website. The ENVISION Project’s Consortium collects, maintains and processes the data of the website in a way that ensures their protection. The processing of personal and non-personal data is carried out exclusively by authorized personnel or associates or by partners who are bound with the same obligations regarding personal and non-personal data protection, and all appropriate organizational and technical measures for the security of data and its protection against accidental or unlawful destruction, accidental loss, alteration, prohibited dissemination or access, and any other form of unlawful processing, are implemented.

Although we make every effort to ensure the smooth operation of the network infrastructure, it is not guaranteed that the operation of this website or its servers will be unimpeded or unmistakable, free from viruses or other similar problems. We are doing our best to keep your information secure and we take protective measures to prevent the loss, misuse, or modification of your data. However, since no protection system, data transmission or data transfer system over the internet can provide 100% security, ENVISION does not guarantee the security of its servers or the security of the infrastructure through which data is transmitted from the users’ personal computer to ENVISION’s servers or the security of any information received either by ENVISION or any other third party through this website.

Collection, processing, and protection of personal data

Ordinary users can visit the platform without providing any personal information. However, registration on the platform requires the provision of information, data or personal data, such as name and e-mail address, as well as the use of cookies. That information is used for the identification of the person of the account and the support of the website’s purpose, as defined by Law.

The platform will only collect users’ personal data when they themselves provide it voluntarily for the purpose of accessing the website. When registering on the platform, users’ consent is required in the collection, use and transmission of their personal data under the terms of this privacy policy.

The user will accept and consent that ENVISION, under the terms of the provisions of the General Data Protection Regulation (GDPR) 679/2016, will keep a file and process his personal data collected through the website, in order for the user to access the provided electronic applications, and to support and execute the relationship between the user and the website, for statistical or general purposes or for the fulfillment of the mission of the ENVISION e-learning platform, in accordance with the Law.

Except of the aforementioned use of users’ data and unless expressly required by Law, ENVISION will not transmit, disseminate or otherwise disclose any information provided by the users without their consent or explicit order.

The e-learning platform is fully compliant with the General Data Protection Regulation (GDPR) 679/2016. Specifically, personal data are subject to legal processing in a transparent manner. The data are collected for specific, explicit and legitimate purposes and are not processed incompatibly with the original purposes. Further processing may only occur for the purposes of archiving or improving the website or for statistical purposes. The data that are being processed are appropriate, relevant and limited to the necessary for the purposes for which they were originally collected. The data are kept in a format that allows the identification of individuals only for the period required by Law.
